Terms & Conditions
1. Rates, Taxes & Gratuity
1.1 Nightly rates are quoted in United States Dollars (USD) and vary by season and by the configuration booked. The rate confirmed in writing at the time of booking applies to your stay.

1.2 A 12% Turks & Caicos Islands government accommodation tax and a 10% staff gratuity are applied to the nightly rate.

1.3 Provisioning, fuel, additional services, and utility usage exceeding the included allowance will be billed separately and are the responsibility of the Client.

1.4 Minimum-stay requirements apply: 4 nights for most dates, 6 nights for Thanksgiving, and 10 nights for the Festive season (late December – early January).
2. Payment & Accounts
2.1 To confirm a reservation, a deposit equal to 50% of the Rental Fee, together with the Security Deposit, is required at the time of booking. The remaining balance of the Rental Fee is due no later than 60 days prior to the Arrival Date.

2.2 Wiring instructions are provided with the invoice. Any bank or wiring charges are the responsibility of the Client.

2.3 If payment is not received by the due dates, the Owner may treat the booking as cancelled and apply the cancellation terms in Section 3.
3. Cancellation
3.1 The Owner may, in its sole and absolute discretion, elect whether to make a refund for any reservation cancelled 61 days or more prior to the Arrival Date, less an administration fee of $200.

3.2 In no event will a refund be made for any cancellation made within 60 days or less of the scheduled Arrival Date.

3.3 We strongly recommend that the Client obtains suitable travel insurance to guard against the cost of unexpected cancellations.
4. Security Deposit
4.1 The Client agrees to pay the applicable Security Deposit in accordance with Section 2. The Security Deposit serves as security for any breakages, damages, additional cleaning costs, excess utility consumption, and any other costs incurred that may become due under this Rental Agreement.

4.2 Utilities and incidentals are deducted from the Security Deposit prior to refund. The unused balance is refunded within 15 days after the scheduled Departure Date, less bank wiring charges.

4.3 In the event that the Security Deposit does not fully cover any additional charges, the Client agrees to remit the outstanding balance upon receipt of a detailed invoice from the Owner, together with supporting documentation.
5. What's Included
5.1 The following are included with the Rental Fee: general power, water, cable TV, swimming pool, Wi-Fi, and use of one Jeep Wrangler for the duration of the rental. Airport transfers for up to eight guests are coordinated as part of your stay.

5.2 The Client is responsible for the cost of fuel and for any damage to the vehicle over and above normal wear and tear.

5.3 A $500 credit toward electricity, gas, and water is included for stays of six nights (approximately $84 per day). Any usage above this amount is deducted from the Security Deposit, with documentation of such charges provided.
6. Rental Period
6.1 Rentals commence at 4:00 PM on the day of arrival and end at 11:00 AM on the day of departure, when the Property must be vacated.

6.2 The Property must be vacated by the agreed departure time. Failure to do so may result in additional charges, including an additional night's Rental Fee, as well as any costs or losses incurred by the Owner because of the delayed occupancy for subsequent guests. Such amounts may be deducted from the Security Deposit.
7. Occupancy
7.1 Villa Doma can accommodate varying group sizes based on the accommodation configuration reserved, whether seven-bedrooms or full nine-bedrooms. The maximum occupancy permitted for your stay will be confirmed in writing at the time of booking and may not be exceeded without the Owner's prior written approval.
8. Staff
8.1 The Rental Fee includes the provision of appropriate staff, comprising a chef for three daily meals, one butler (ten hours daily), two housekeepers, and concierge service.

8.2 Additional staff is the sole financial responsibility of the Client. The Client is responsible for the full cost of any damage, breakages, or exceptional cleaning required.
9. Provisioning & Incidentals
9.1 The Client is solely responsible for the payment of all food, beverages, liquor, and other incidentals purchased by staff at the request of the guests during the rental period.

9.2 Villa Doma applies a 15% fee for grocery provisioning facilitated by our staff, applied to the final provisioning invoice.

9.3 Import, duty, and delivery charges apply when an item is a special order from overseas.
10. Concierge & Third-Party Services
10.1 Staff may assist the Client in booking or recommending ancillary services, including car rentals, taxis, tourist excursions, fishing guides, medical care, nannies, restaurants, shopping, or similar services intended to enhance the Client's stay.

10.2 In providing such assistance, the Owner, its staff, and representatives do not accept any responsibility or liability, whether as agent, principal, or otherwise, for services booked by the Client.

10.3 The Owner, its staff, and representatives are in no way responsible or otherwise liable for services beyond the normal operation of the Property as a short-term vacation rental.
11. Faulty Equipment
11.1 The Owner undertakes to repair or replace any faulty equipment with all due diligence. The Client must notify the Owner immediately upon discovering any faulty equipment.

11.2 No claims for losses, however described, will be entertained in respect of equipment that remains faulty for reasons beyond the Owner's control.
12. Maintenance & Island Conditions
12.1 While every effort is made to maintain the Property in good order, wear and tear on a rental property such as Villa Doma is unavoidable. Please notify staff as soon as possible if a problem exists, and every effort will be made to rectify it promptly.

12.2 Providenciales, like many small island destinations, has limited access to certain goods, services, and infrastructure commonly available in the United States, Canada, and Europe. The Owner and its representatives shall not be held liable for interruptions, deficiencies, or failures in services provided by third parties, including but not limited to utility providers, telecommunications services, transportation operators, and public services such as waste collection.

While every reasonable effort will be made to address and resolve any such issues promptly, refund, or compensation shall not be provided for any interruption, delay, or lack of service that is beyond the Owner's reasonable control.
13. Liability & Indemnity
13.1 To the fullest extent permitted by law, the Owner, its staff, and agents accept no responsibility or liability for any accident, injury, loss, or damage whatsoever to Clients, their guests, and their belongings during the stay, all of which are expressly disclaimed. This includes, but is not limited to, any matter arising from use of the Property or service by staff, use of the swimming pool, slip and fall, and loss of or damage to personal belongings, however caused.

13.2 Anyone using the swimming pool does so at his or her own risk and acknowledges that no diving is allowed. The Client is specifically advised not to allow children to swim or play in the swimming pool or the ocean without responsible adult supervision, and agrees to inform all guests of this clause and of the potential dangers associated with the ocean, the swimming pool, and water sports generally.

13.3 The Property has many polished and tiled floors that can be slippery when wet, and care should be taken accordingly.

13.4 To the fullest extent permitted by law, the aggregate liability of the Owner, its affiliates, employees, agents, contractors, and representatives arising out of or relating to this Rental Agreement, the Property, or the Client's stay shall not exceed the total Rental Fee paid by the Client.

The Client accepts responsibility for the conduct of all guests, invitees, and visitors occupying or visiting the Property during the rental period. The Client shall indemnify, defend, and hold harmless the Owner, its affiliates, employees, agents, contractors, and representatives from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to the acts, omissions, negligence, misconduct, or violation of this Rental Agreement by the Client, any guest, invitee, or visitor, including claims for personal injury, death, property damage, or other losses asserted by third parties.
14. Security
14.1 While crime levels in the Turks & Caicos Islands are low, the Client should take similar precautions to those they would take at home to guard against petty theft.
15. Property Unavailability
15.1 If, for reasons beyond the Owner's control (for example, fire damage), the Property is not available on the date booked, all Rental Fees paid in advance will be refunded in full, but the Client will have no further claim against the Owner under this Rental Agreement or otherwise concerning the Property.
16. Access
16.1 The Owner reserves the right at all times to have reasonable access to the Property for its staff and representatives.
17. Complaints
17.1 In the event of a complaint, the Client should in the first instance notify staff so that an on-the-spot investigation can be made during the rental period. The Owner reserves the right to determine, in its sole and reasonable discretion, all unresolved complaints regarding the standard of the Property.
18. Breach & Termination
18.1 The Owner reserves the right to terminate this Rental Agreement in the event of a material breach of its terms by the Client or any guest. Should such a situation arise, the Client and all guests may be required to vacate the Property immediately, and the Owner or its authorized representatives may re-enter the Property as reasonably necessary. Any termination pursuant to this provision shall not entitle the Client to a refund for unused rental nights or services.
19. Governing Law & Jurisdiction
19.1 This Rental Agreement is governed by the laws of the Turks & Caicos Islands, whose courts have sole and exclusive jurisdiction to hear and determine any dispute arising under it and from the Client's occupation of the Property.

19.2 The Client waives the jurisdiction of any other court or tribunal, without regard to any conflict-of-laws principles, and waives any objection to Turks & Caicos Islands venue on the basis of inconvenient forum. The Client acknowledges that this provision is of the essence of this Rental Agreement, and that any action brought outside the Turks & Caicos Islands should be dismissed for lack of jurisdiction.
20. Severability
20.1 If any provision of this Rental Agreement is determined to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of the remaining provisions. This Rental Agreement shall be construed and enforced as if the invalid or unenforceable provision had never been included.
